1.4  Responsibility

ETT Lighting, d.o.o. is not responsible for disruptions in the course of the service resulting from user behaviour (virus-infected computer) or path providers infrastructure used by the online store service (for example, Internet service failure).

As a provider, we strive to ensure timely and correct publication of data. It may happen that due to the change in prices, it may happen that the information on the website is still uncorrected. In this case, we notify the customer of the changes and allow him to withdraw from the order or replace the order.


1.5  Complaints and disputes

The provider complies with applicable consumer protection legislation. The provider makes every effort to fulfill its duty to establish an effective complaint handling system and to designate a person with whom, in the event of problems, the customer can contact by telephone or e-mail.

The bidder will acknowledge receipt of the complaint within five working days and inform the buyer how long it will take to process it and keep him informed of the progress of the procedure.

The provider is aware that the essential feature of a consumer dispute, at least as far as judicial settlement is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to the consumer not initiating a dispute in court. Therefore, the provider strives to the best of its ability to resolve any disputes amicably.

3. Payment, Delivery and  Prices

3.1 Purchase process

1.1  Orders can be placed 7 days a week / 24 hours a day.

Before you place your order, you can modify the contents of your shopping cart. You can add additional items, modify the amount of items, or delete items. When you are convinced you want to purchase the items in the shopping cart, click on »order«.If this is the first time you are buying at our online store, you will have to click on »create account«. If you have already registered, just enter your email address and your password. As a registered user, you will be able to review your orders. Check if your delivery-address and telephone number is correct, as they will be needed for the purpose of communication at the delivery of goods. In the menu delivery you can check the cost of delivery. Confirm your purchase by clicking »confirm order«. The confirmation of your purchase will be immediately sent to your email address.

1.2  Order confirmed-contract made.

The seller looks through the order in 48 hours, checks delivery and confirms or refuses the order with a given reason.By order confirmation, the seller informs the purchaser of possible delivery time by email.

1.3  Product dispatched

The seller packs and dispatches product(s) in promised time together with the original receipt, users’ manual and warranty.


3.2 Method of payment

The provider offers the following payment methods .

  • by transfer to the account of an online store manager (by bid / bill);
  • by credit card via the Stripe online payment interface (Visa, Mastercard, Maestro and American Express)

The purchase contract (order) is stored electronically on the provider’s server.

In the case of payment on delivery, the ordered goods are paid to the supplier of the goods upon receipt.

In case you want to pay for your order via the offer / proforma invoice, please indicate this on the order form. We will send an offer / proforma invoice * to your e-mail as soon as possible. Once the payment of the offer / proforma invoice is visible on our bank account, we process your order to the end and ensure the delivery / acceptance of the goods.

Personal collection is only possible for goods already paid for. When your goods are in our warehouse, we will notify you in a timely manner.

The seller delivers the goods or services within the promised time.

Contractual partners for the delivery of shipments are GLS, Pošta Slovenije and DHL.

The risk of loss of or damage to the dispatched goods passes from the seller to the buyer when the goods are physically received or when the goods are physically received by a third party other than the carrier and designated for this purpose by the buyer.


2. SHIPPING COST  

The cost of delivery is listed in the table with information in the online catalog / publication for each product and is always printed for information and added to the online shopping cart when placing the order.


3. DELIVERY TIME

Delivery is expected to take place during the week until 16.00 and on Saturday in the morning until 12.00 at the address you enter when placing the order.

If you are not at home at the time of delivery, the selected courier will inform you of alternative options for picking up your order.


3.4 Prices

All prices are given in EUR and include value added tax VAT. Prices are confirmed for the ordering day and can change daily without previous notice. Prices marked as »instead of« are old primary selling prices of articles in our shops.

Prices are valid at the time of the award and do not have a predetermined validity. Prices apply in the case of payment with the above mentioned payment methods, subject to the above conditions

The purchase contract between the bidder and the buyer is concluded at the moment when the bidder confirms the order. From this moment on, all prices and other conditions are fixed and apply to both the provider and the buyer.

Despite the extraordinary effort to provide the most up-to-date and accurate data, it may happen that the price information is incorrect. In this case, or in the event that the price of the item changes during the processing of the order, the provider will allow the buyer to withdraw from the purchase, and at the same time the bidder will offer the buyer a solution that will go to mutual satisfaction.


4. Guarantee and Reclamation

4.1 Withdrawal from order

You have the right to cancel this contract within 14 days without giving any reason.

It is also sufficient for the customer to notify us in writing within 14 days that he is withdrawing from the order, without having to state the reason for his decision. In this case, the unused and undamaged goods must be returned to us in the original packaging within the next 14 days.

The only cost borne by the consumer in connection with the withdrawal from the order is the direct cost of shipping (receiving and returning the goods).

When returning the goods, the consumer also sends an invoice for the goods and personal data and a transaction account to which he wants the payment to be returned.


4.2 Return of Damaged Goods

In case the goods are damaged, its content is missing or is showing the signs of being open; the purchaser has to initiate the procedure of complaint at the contracting business partner for delivery. Together we will make sure that the complaint will be solved as quickly as possible.


4.3 Complaint

If the goods do not have features that the seller explicitly promised, if the seller sent the wrong product, the wrong quantity, color, or if goods otherwise deviate from the purchaser's order, the purchaser is entitled to claim the goods. After prior agreement with the seller, the goods can be returned by post or be brought to our company personally.

4.4 Warranty

The manufacturer is in compliance with the law obliged to provide the purchaser a guarantee for the proper functioning of the purchased goods. The purchaser can claim the warranty directly at the manufacturer or their authorized service center. The purchaser can claim the warranty with a warranty certificate and the receipt of the seller. 

For more substantial product issues, please allow us additional time to address and rectify the fault. This extended timeframe is essential as it enables us to not only fix the problem but also enhance the overall performance of the product when the issue is accurately identified. Your satisfaction is our top priority, and we are committed to ensuring the highest quality and functionality of our products.  

Pursuant to the detailed conditions herein, we guarantee, that those products that are sold by authorised merchants and labelled with the trademark “Luxar” shall be free of manufacturing and material defects when used as intended.


Unless confirmed otherwise by the manufacturer, the guarantee period starts on the date of delivery of the product. The period of warranty is specified in the official datasheets of Luxar Lighting which are listed on each product.



The guarantee applies exclusively upon the condition that:

  • The products are used in conformity with the stated product and usage specifications (particularly according to the specification sheet, product datasheet, product label and the like) and with the statutory provisions and standards (e.g. operator’s duties to check); the products were professionally installed and placed in service according to the installation instructions accompanying the product;
  • The maintenance and repair services on the products have been performed exclusively in accordance with the manufacturer’s specifications; If guarantee is linked to mandatory remote maintenance by the manufacturer, the customer will provide any infrastructure required for remote maintenance such as Internet connectivity;
  • Services, such as software upgrades or added functionality, have been performed exclusively by the manufacturer or a third party named by the manufacturer;
  • The acceptable limits for temperatures and voltages according to the relevant technical or product-specific standards indicated are not exceeded;
  • The product is not exposed to any unintended mechanical and/or chemical stresses;
  • No programmable device parameters of the manufacturer are modified, unless the manufacturer has expressly consented to such modifications;  
  • In addition to those mentioned above, the following additional conditions apply to outdoor applications: 
  • The luminaires must be professionally cleaned on a regular basis, but at least every 6 months;  The products are used in application classes C1-C5 pursuant to ISO 9223-2012.

    All replacement products or parts may contain new or recycled materials whose performance and reliability are equivalent to new products or parts. The dimensions and design of the replacement product may deviate from the original product. ‘Recycled materials’ are parts or products that are used or reconditioned and are not new. Although such parts or products are not new, after reconditioning or overhaul the condition is like new with respect to performance and reliability. The functionality of all replacement products or parts is equivalent to that of the product or part being replaced. Replacement products or parts shall not exhibit any material or manufacturing defects for the remainder of the applicable guarantee period for the product that is replaced or in which they are installed.


    • Any incidental costs arising in connection with the correction of defects (guarantee fulfilment), such as for installation and removal, transport of the defective and repaired or new product, disposal, travel and transit time, hoists, scaffolding); these costs are borne by the buyer
    • Mechanical damage, in particular if caused by vandalism, weather, sand or scratching;
    • Surface damage to less than 5% of the entire surface of the luminaire;
    • Wear parts, such as all standard lamps, batteries (unless defined otherwise in the relevant product datasheets); hard drives; computers and servers that contain hard disks or mechanical wear parts;
    • Plastic parts (e.g. made of polycarbonate) to the extent they discolour or embrittle due to the natural ageing process;
    • Colour or surface changes to luminaires mounted outdoors at a distance of less than 5 km from a coastline;
    • Electronic components, products and luminaires that ETT Lighting d.o.o. sells as trading goods under third-party labels, as well as luminaires of other manufacturers;
    • Settings or parameter settings on equipment that change based on wear and tear, fatigue or soiling;
    • Product defects that are attributable to software errors, bugs, viruses or the like;
    • Damage associated with force majeure;
    • Required recommissioning, software updates, etc.;
    • Damages based on designs, specifications or instructions that were provided by the customer and other third parties;


    The guarantee expires immediately if the customer or third parties make or perform changes, repairs, service work or troubleshooting without the prior written consent of the guarantor.

    The colour tolerance of LED modules is not covered by the manufacturer’s guarantee. The luminous flux and performance are subject to a tolerance of ±10% in the case of a new LED module. All relevant technical data are mentioned in the product and application specifications. In the case of subsequent deliveries of LED modules, there may be deviations in light properties with regard to the original products due to technical progress and usage- induced change in the luminous flux and light colour of products.

    The customer’s guarantee rights under statute are not excluded, limited or changed by these terms of guarantee.

DEKO-LIGHT GRANTS 5 YEARS WARRANTY ON PRODUCTS OF THE BRANDS KAPEGO, DEKO-LIGHT AND REPROFIL

The products of our brands Kapego, DEKO-LIGHT and Reprofil are manufactured in accordance with strict quality guidelines and are subject to regular checks during and after production. We underline this quality promise, in accordance with the following conditions, by granting a manufacturer's warranty of 5 years from the invoice date 01.10.2018 and for goods purchases within the EU. The legal claims for defects, in particular the warranty claims according to § 437 BGB (German Civil Code) remain unaffected.

CONDITIONS FOR A 5-YEAR WARRANTY CLAIM:

  1. The products must be used in accordance with the given product and application specifications (according to the data sheet and product standards) and must have been installed and commissioned professionally, if necessary according to the installation instructions.
  2. The limit values for the mains voltage as well as the ambient temperatures, especially when used outdoors, possibly also solar radiation, must not be exceeded or undercut.
  3.  No changes / modifications may be made to the product.
  4. The product must not be exposed to any loads that are not in accordance with its intended use (e.g. cleaning agents, alkalis, acids, road salt, etc.) or extreme ambient conditions (e.g. seawater, chlorinated water, desert influences, etc.).
  5. The warranty is valid for an operating time of max. 4,500 hours / year, which is the standard market value for professional applications.
  6.  For use in industrial plants, prior written agreement and approval from Deko-Light is required.
  7. A decrease in luminous flux as well as a colour tolerance in the course of the life cycle of an LED corresponds to the current state of the art and is therefore not part of the warranty.

ARE EXCLUDED FROM THIS WARRANTY CLAIM:

  1. Light sources (conventional, separately replaceable and LED retrofit))
  2. Custom-made products
  3. Reduced goods (from sales and promotion lists)
  4. Batteries
  5. Merchandise that Deko-Light sells under another's name
  6. Damage that can be traced back to user negligence
  7. Damage, in particular age-related changes that do not impair the function of the product (e.g. changes to the paintwork / surface, material composition, cracks, scratches, flaking or similar).
  8. Damage due to improper or incorrect use, application or assembly
  9. Damage caused by dirt and moisture due to lack of cleaning / maintenance
  10. Damage due to power supply conditions, including over- or under voltage, voltage spikes, harmonics or similar.
  11. Damage due to force majeure, mechanical violence and vandalism
  12. Components and parts that are subject to natural wear, e.g. seals, plastic parts, connection lines
  13. Indirect damage arising in connection with the rectification of defects (e.g. for disassembly and assembly of the luminaires, travel, scaffolding, loss of business). Furthermore, any liability for damages is excluded, in particular liability for consequential damages. The statutory claims for defects, in particular the warranty claims according to § 437 BGB (German Civil Code) remain unaffected.

Warranty services (repair or replacement) do not extend the warranty period of a product. The warranty does not apply to failures that have already been remedied under the warranty by replacement, repair or price reduction.

In accordance with the detailed conditions here in, Tridonic guarantees that, during the guarantee period stated in the data sheet from the date of manufacturing, those products that are sold by authorised merchants and labelled with the trademark “Tridonic” shall be free of manufacturing and material defects when used as intended.

The guarantee applies exclusively upon condition that: 

  1. The products are used in conformity with the stated product and usage specifications (particularly according to the data sheet, specification sheet, product brochure, product label and the like). If the operating hours mentioned in the table “Expected life-time” (see data sheet) will actually be exceeded, the guarantee period will be reduced according to the stated expected life-time values.
  2. The products were professionally installed and placed in service according to the installation instructions.
  3. The maintenance and repair services on the products have been performed exclusively in accordance with the manufacturer’s specifications.
  4. The acceptable limits for temperatures and voltages according to the relevant technical or product-specific standards indicated are not exceeded.
  5. The product is not exposed to any unintended mechanical and/or chemical stresses and/or other harmful environmental influences.

The guarantee exclusively covers product failures that are caused by proven material, design or manufacturing flaws and that exceed the mean nominal failure rate. In the case of electronic control gears or components such as LED modules and emergency lighting batteries, the mean nominal failure rate is 0.2%/1,000 hours of operation, unless the median nominal service life and nominal failure rate of the controllers or components are otherwise defined in the product and usage specifications (particularly according to the data sheet, specification sheet, product brochure and the like). If the operating hours mentioned in the table “Expected life-time” (see data sheet) will actually be exceeded, the guarantee period will be reduced according to the stated expected life-time values. The customer is not entitled to make any claims under this manufacturer’s guarantee unless the customer notifies the guarantor – or the sales subsidiary of the Tridonic Group in the respective country in which the product was first purchased and placed in service – of the case that is covered by the guarantee within 30 days (arrival) of noticing the defect; the notification shall be in writing with a copy of the applicable purchase agreement or invoice and corresponding proof of the defect that has appeared. If, on inspection of the product, it should appear that the case is covered by the guarantee, it is within the discretion of the guarantor to repair the defective product, to deliver an equivalent product free of charge or to offer a price reduction. This guarantee shall not apply to product failures that have already been corrected through exchange, repair or price reduction within the scope of the guarantee. When the guarantee has been fulfilled, the guarantee period does not start to run again.

Guarantee cases are processed through the respective sales subsidiary of the Tridonic Group in the respective country in which the product was acquired new and placed in service.

  1. All replacement products or parts may contain new or recycled materials whose performance and reliability are equivalent to new products or parts.   2. The guarantee shall not apply to: 
    1. Any incidental costs arising in connection with the correction of defects (guarantee fulfilment), such as for installation and removal, transport of the defective and repaired or new product, disposal, travel and transit time, hoists, scaffolding); these costs are borne by the buyer.
    2. Wear parts, such as all standard lamps (excluding LED modules), batteries (excluding emergency batteries); computers and servers that contain hard disks or mechanical wear parts.
    3. Accessories, such as cables, covers and resistors for current adjustment.
    4. Plastic parts (e.g. made of polycarbonate) to the extent they discolour or become brittle due to the natural ageing process.
    5. Electronic components, products that Tridonic sells as merchandise, such as touch panels, IT-network devices and computers under third-party labels.
    6. Settings or parameter settings on equipment that change based on wear and tear, fatigue or soiling.
    7. Product defects that are attributable to software errors, bugs, viruses or the like.
    8. Services that are needed from time to time, such as recommissioning, software updates, etc.
  3. The guarantee expires immediately if the customer or third parties make or perform changes, repairs, service work or troubleshooting without the prior written consent of the guarantor.   4. Additional information on LED products: In the case of LED modules, a drop in the value of the luminous flux of up to 0.6%/1,000 hours of operation is the state of the technology and thus not covered by the guarantee, unless otherwise defined in the product and usage specifications (particularly according to the data sheet, specification sheet, product brochure and the like). The colour tolerance of LED modules is not covered by the manufacturer’s guarantee. The luminous flux and performance are subject to tolerances in the case of a new LED module. All relevant technical data is mentioned in the product and application specifications (particularly according to the data sheet, specification sheet, product brochure and the like). In the case of subsequent deliveries of LED modules, there may be deviations in light properties with regard to the original products due to technical progress and usage-induced change in the luminous flux and light colour of products.

This warranty certificate by LEDS C4, S.A. is for the consumer and user, to guarantee the product works properly, and it covers the model’s possible repair or supply of spare parts due to manufacturing defects for a period of 5 years from the delivery date, according to the general terms and conditions established below.


1. Exclusions and Limitations of Warranty:

A. Warranty rights may be claimed during the warranty period, established in each case and immediately upon detecting the malfunction.

B. In any case, the consumer must inform the seller of the lack of conformity within two months of discovering it, and the consumer is responsible for any damages caused by a delay in communication, without compromising their right to a reparation or replacement, to which they are entitled.

C. In general, damages and malfunctions of products originating from the following means are exempt from the warranty rights established in this warranty certificate:

  1. accidents or negligent, improper and inappropriate use;
  2.  failure to comply with the installation, use and maintenance instructions supplied or published and those established in the regulations and technical and safety standards in force, of national or local scope, which were applicable at all times (Low Voltage Electrotechnical Regulations, and Complementary technical instructions, Electromagnetic Compatibility, European Standard EN-60598, etcetera);
  3. exposure to corrosive environments or aggressive gasses of chemical origin;
  4. cross-section and length of wiring unsuitable for the characteristics and cross-section of the electrical equipment connection terminals;
  5. erroneous modifications, installations or uses, or which have not been conducted by authorized personnel of the LEDSC4, S. A. After-Sales Service;
  6. damage caused by electrical overloads, floods, infestations, earthquakes, actions of third parties or any other cause of force majeure beyond the normal operating conditions of the equipment and the control of LEDS C4, S. A.;
  7. use of the product at a room temperature below -15°C or above 30°C;
  8. in LED light sources, faults less than 0.6% per every 1000h;
  9. loss of luminous flux less than 30% in LED light sources;
  10. in LED light sources, operation above 4000h per year;
  11. relative humidity in the installation above 80%, or exceeding the IP rating of the product if specified;
  12. closed luminaires, with less than 10mm of air around the product structure;
  13. use of operating or regulation systems not approved by LEDS C4, S.A. or that are incompatible with the product supplied.
  14. deterioration of the finishes that does not prevent the luminaire from functioning correctly is exempt from the warranty established herein. The warranty period for finishes is set according to the regulations of the country where the product is installed.
  15. Battery deterioration is exempt from the warranty rights established herein.
  16. For fans, in addition to our product warranty, we offer a 10-year warranty for the motor.

D. The warranty rights established herein do not cover the transport costs of defective equipment or lighting components, resulting from the return of products to LEDS C4, S.A. and their subsequent replacement to the client. In the same way, the warranty rights do not cover the costs of disassembling the defective equipment, nor those of the subsequent reinstallation of the replaced equipment.

E. If the repair is unsatisfactory and the object does not meet the optimum conditions to fulfil the use for which it is intended, the warranty holder is entitled to a replacement of the acquired object for another of identical features, a price reduction or the termination of the contract.

F. LEDS C4, S.A. reserves the right to supply a different model of equipment or component in response to the accepted warranty claims and as a replacement, in the event that the original model is no longer manufactured. All replaced equipment or components will benefit from a one-year warranty from their delivery date or installation.


2. Claiming warranty rights:

The client or user of lighting components supplied by LEDS C4, S.A., who is considered to have justified reasons for claiming warranty rights as established in this document, must proceed as follows:

Provide immediate written notification to LEDS C4, S.A. including the receipt or invoice.

Once this claim has been received by LEDS C4, S.A., the After-Sales Service Department will proceed to its analysis, and resolution or not, under this limited warranty certificate, and will inform the client accordingly and provide instructions to be followed, as soon as possible.

The return of the equipment, which is the object of the claim, cannot be made without prior written authorization by the LEDSC4, S.A. After-Sales Service Department. The product must be returned correctly in its original packaging and with all its accessories. Under no circumstances will LEDS C4, S.A. be responsible for any damages that may occur during delivery.

If, at the request of the client and on grounds of urgency, the client requires LEDS C4, S.A. to replace immediately the equipment or component, object of the claim, prior to the resolution of the claim by the After-Sales Service Department, this request must be accompanied by a Purchase Order from the Sales Department.

Once the claim has been resolved by the After-Sales Service Department, this Purchase Order will be cancelled by issuing a Credit Note, in the event that the resolution of the claim is applicable.


3. Limitations of liability:

LEDS C4, S.A. shall not be liable to the client, directly or indirectly, for any breach or delay in the implementation of its warranty obligations, which may be caused by force majeure or any other unforeseen incident beyond the control of LEDS C4, S.A.

 

The liability of LEDS C4, S.A. deriving from this Warranty Certificate will be limited to the obligations expressed above and, quantitatively, to the amount of the invoice paid by the client for the purchase of the equipment that is the object of the claim, expressly excluding any liability for indirect damages such as loss of revenue or operating profits, etcetera.

Any other warranty claim that is not expressly mentioned in this certificate is excluded.

The warranty shall be given for the period of:

a) LED luminaires made by PXF LIGHTING

​– standard warranty – 24 months;

​– extended warranty – 60 months.

In order to obtain the extended warranty, the warranty form shall be be filled in and sent at the following e-mail address: gwarancja@pxf.pl, within 30 days from the date of issuing the invoice by PXF LIGHITNG.

b) Other luminaires made by PXF LIGHTING:

​– standard warranty – 24 months,

​– extended warranty – either 36 months or 60 months.


c) Luminaires distributed by PXF LIGHTING:

​– the warranty period is compliant with the manufacturer’s declaration.


d) Emergency power modules:

​– standard warranty – 24 months;

​– extended warranty – not applicable.


e) Control systems of emergency and evacuation lighting:

​– standard warranty – 12 months,

​– extended warranty – either 24 months or 36 months.


f) Movement detectors

​– standard warranty – 12 months,

​– extended warranty – not applicable.


The warranty period is effective with a luminaire’s standard operating time of up to four thousand hours per year. In cases where the luminaires’ operating time surpasses four thousand hours per year, the warranty period shall be proportionally shortened by 30 calendar days for each thousand hours of operating above the standard operating time of four thousand hours.


The warranty covers only physical defects of goods which appeared due to causes found in the goods sold, i.e. being a result of production faults, construction or design errors, or material defects.


Appropriate storage and appropriate installation of the products by accordingly qualified personnel as well as appropriate/compliant with the operating manual usage and running relevant records of usage are a condition to be met In order to be able to enjoy the warranty rights.


The warranty does not cover:

1)  damage which is mechanical, thermic, (for instance, exceeding the limit values of ambient temperature), chemical (for example, hostile environment) and any other damage resulting from the user’s action or negligence, or from external factors, i.e. wrong parameters of the power mains, for instance, mains overvoltage, lightning or other atmospheric interferences;

2)  usage incompliant with the operating manual;

3)  damage caused by foreign factors which entered the goods, for example, humidity, corrosion, dust, etc.

4) damage resulting from natural, partial or total wear and tear;

5) incorrect power connection;

6) damage resulting from:

​- wrong installation by unqualified personnel without a relevant official electric licence,

​- wrong use of the goods, use contrary to their purpose or incompliant with the operating manual,

​- incorrect maintenance,

​- construction changes of the goods made by the user or third parties,

          ​- circumstances which neither the manufacturer nor the seller is responsible for, particularly those occurred due to use which ​was improper or incompliant with the instructions, or circumstances resulting from other causes on the part of the user or third parties (such as using non-original materials or accessories);

7)  product repairs or modifications carried out by the customer without a due authorisation from ETT Lighting d.o.o. made in written form.

Olympia Electronics guarantees the quality, condition and operation of the goods. The period of warranty is specified in the official catalogue of Olympia Electronics and also in the technical leaflet, which accompanies each product.

 

This warranty ceases to exist if the buyer does not follow the technical instructions included in official documents given by Olympia Electronics or if the buyer modifies the goods provided or has any repairs or re-setting done by a third party, unless Olympia Electronics has fully agreed to them in writing. Products that have been damaged can be returned to the premises of our company for repair or replacement, as long as the warranty period is valid.


Olympia Electronics reserves the right to repair or to replace the returned goods and to or not charge the buyer depending on the reason of defection. Olympia Electronics reserves the right to charge or not the buyer the transportation cost.

Raytech Manufacturer Guarantee

The guarantee of Raytech Manufacturers is applicable for 24 months from the shipping date for Products manufactured directly by Raytech. If the BUYER notices manufacturing defects on one or more Products, they must inform us within 10 days of discovering any faults or defects.The request must be made in writing and must indicate the product which caused damage, the place and, with reasonable approximation, the date of purchase; it must also contain images of the product, if still available.


The guarantee excludes defects due to, or connected to, an improper use of the Products by the BUYER.


The guarantee is expressly limited to the repair or replacement of the defective product or, when this is not possible, to the refund of the purchase price. In no case can damages or other compensation claims be brought against RAYTECH for what is described above, including but not limited to, damage to image, delayed production, damages to persons or things, damages to machinery, etc.


Within the confines of the law, for products that are not part of the RAYTECH brand, all requests regarding a guarantee, where relevant, must be made in compliance with the terms and conditions of the manufacturer’s standard guarantee, which may be provided along with the Products purchased. 

If deficiencies of goods/a work are already obvious at the time of the conclusion of the Agreement or the Customer was already aware of them at this point, if the Customer did not observe all conditions of the Contractor with regard to the subject-matter of the Agreement, if improvement work was carried out without our approval, if material of unknown origin was installed, or the Customer did not comply with his contractual obligations, the warranty will be ruled out.

In addition, the Customer must, to the extent acceptable for him, inspect the goods/the work immediately after delivery as to their completeness, correctness and absence of any defects, and immediately report to us in writing any shortcomings, including all shortfall quantities and all incorrect deliveries as well as transport damage upon delivery, yet not later than two working days after receipt of the goods or services. If goods are directly shipped to third parties, the time-limits applicable to the inspection and obligation to give notice of defects will commence upon receipt of the goods by the third party.

If a notice of defects is not submitted or submitted late, the goods/the work shall be considered approved. The assertion of warranty or compensation claims, including consequential damage and the right of avoidance on the grounds of error in connection with defects, are ruled out in these cases. The burden of proof that the goods/the work are defective and that the defect was present upon delivery shall always lie with the Customer, even if the defect surfaces within six months after delivery.

If there are warranty claims due to a defect, we may at our discretion choose to improve or replace the goods/the work, reduce the remuneration accordingly, or cancel the Agreement. If warranty claims exists, this shall not entitle the Customer to withhold the remuneration until the time of the improvement or the replacement of the goods.

Claims from defects in connection with any kind of supply and service, regardless of the legal grounds they are based on (in particular warranty, damages, error, special right of recourse) must be in any event asserted in court within six months after delivery. The above period begins on the day of the delivery of the goods/the work.

Costs incurred as a result of the removal of defects, such as installation or dismantlement or transport and material shall be borne by the Customer.

In the case of custom-made products on the basis of information, drawings, etc. of the Customer, the Seller only guarantees their proper execution or manufacturing.

Expenses incurring as a result of repairs will only be accepted if the Customer notifies the Seller thereof beforehand and the latter confirms the reimbursement of these expenses in writing. If the Seller is not informed about a repair by third parties or the goods are modified accordingly without notification, the Seller does not grant any warranty for such work.

Where these are defects or damages verifiably caused by a manufacturing or material error, the Seller may offer a replacement or a removal of the defects free of charge.

The guarantee period is generally 24 months. The guarantee period may be longer for some products. In this case, information about the guarantee period shall be included in the packaging of a given product or in the catalogue card available on our website.

The guarantee covers only physical defects of the products that occurred during the guarantee period and which arose for reasons existing in the product when it was sold, after which time the risk of accidental damage and loss of goods was transferred to the buyer (i.e. usually at the time of delivery). The guarantee covers only defects related to the functional properties of items and if loss of function occurs after ordinary use.

The guarantee does not cover, in particular, defects resulting from improper use, assembly, independent modifications or repairs made inconsistently with the instructions for use or contrary to technical knowledge. The guarantee does not cover defects resulting from improper transport, storage or maintenance of products, as well as mechanical damage resulting from accidents, natural disasters, unusual conditions of use or storage, such as high temperature, pressure, humidity, contact with chemical agents, etc. The guarantee does not apply to products used contrary to the manuals or not in accordance with their intended use.

The guarantee does not cover changes in the characteristics of the products resulting from normal wear and tear over time. Due to the physical and chemical properties of light emitting diodes (LEDs), it is to be expected that the luminous intensity decreases by up to 30% of its original value and/or the light colour changes slightly while using and with the passing of time.

GENERAL CONDITIONS

The Seller provides a warranty for the Lighting Products manufactured by it, on the terms described in these General Warranty Conditions.

All deliveries of the Seller's products, goods and services are carried out on the basis of these General Warranty Conditions. These GWC are valid for all sales agreements performed from the effective date of these GWC. The Buyer declares that upon placing an order with the Seller, it fully accepts the provisions of these GWC.

These GWC may not be changed, replaced or supplemented without the prior written consent of the Seller. In particular, any special conditions specified by the Buyer in an order or correspondence do not exclude the provisions of these GWC unless the Seller previously accepts in writing other warranty terms than those resulting from these GWC.


WARRANTY PERIOD

The warranty begins from the date of purchase of the Lighting Product by the Buyer, as indicated in the VAT invoice or receipt confirming the purchase.

The Seller provides a warranty for the Lighting Products sold for the period of:

  • 7 years for IP20 monochrome LED tapes
  • 4 years for RGB, RGBW, RGB-CCT, CCT, K-NF LED tapes with IP20 and IP65 and IP67
  • NEON FLEX LED tapes:   5 years for indoor use |  3 years for outdoor use
  • 4 years for profiles, covers and accessories as well as LED lighting fixtures  (consisting of products subject to a 4-year warranty)
  • 1 year for KA-COM covers and T covers

At the Buyer's request, for selected Lighting Products, it is possible to extend the warranty from 4 to 5 years for an additional fee of 5% of the value of the Lighting Products to which the warranty extension applies. To use the extended warranty, the Buyer is required to pay the fee referred to in the preceding sentence and have this confirmed by the Seller in writing (possible mainly on the purchase invoice).


WARRANTY CONDITIONS

The Lighting Product shall be used, installed and stored in accordance with the information contained in specification sheets and assembly instructions, as well as any other documents provided to the Buyer.

Unless otherwise specified in the specification sheets, the Seller's lighting fixtures are intended for standard operating conditions, i.e. ambient temperature in the range from -10°C to +25°C, humidity <85%, pressure: 690-1060 hPa.

The Lighting Product must not be used in environmental conditions that endanger the structure, paintwork, electrical equipment. Such conditions are: high temperature and humidity, dust, presence of non-inert chemicals in the air, UV radiation, shocks and vibrations unless otherwise specified in the Seller's specification sheet.

Lighting Product must not be exposed to mechanical and/or chemical overloads contrary to their intended purpose, which may endanger the structure of the lighting fixture, paint coating or electronic components inside the lighting fixture.

Ambient temperatures and supply voltage must not exceed the ratings specified for the given Lighting Products in the specifications or technical standards.

Under the warranty the Seller shall repair or replace the defective Lighting Product at its discretion. The Seller's warranty obligations are limited to the release and shipment of the repaired goods or new goods replacing the defective ones (depending on the Seller's choice) to the Buyer to the address provided by him in Europe, and do not include any other works, services or costs, including those relating to the disassembly of defective goods and the assembly of defect-free goods.


LOSS OF WARRANTY

The warranty becomes void when:

  • The Lighting Product is not used as intended
  • The Lighting Product is deliberately damaged
  • The Lighting Product is used in conditions other than those specified in the catalogue and instructions for use
  • The Lighting Product is used in weather conditions other than those indicated in item ("provided that the specification sheet does not allow other conditions of use and operation of the Seller's Lighting Products")
  • Unauthorized modifications, repairs, interference by unauthorized persons
  • Failure to comply with the operating rules, mechanical damage
  • Connecting the LEDs or lighting fixtures to the wrong output voltage of the power supply
  • Incorrect selection of power supplies (e.g. connecting an 18W power supply to a 20W lighting fixture)
  • Improper assembly, storage and/or transport of the Lighting Products
  • Damage caused by force majeure (e.g. power surge, lightning, fire, flood, earthquake)

Warranty and acceptance of obligation to repair defects

Once the agreed terms of payment have been complied with, Seller shall, subject to the conditions hereunder, remedy any defect existing at the time of acceptance of the article in question whether due to faulty design, material or manufacture, that impairs the functioning of said article. From particulars appearing in catalogues, folders, promotional literature as well as written or oral statements which have not been included in the agreement no warranty obligations may be deduced.


Unless special warranty periods operate for individual items the warranty period shall be 12 months. These conditions shall also apply to any goods supplied, or services rendered in respect of goods supplied, that are firmly attached to buildings or the ground.


For improved or exchanged parts, the warranty period shall start again, but shall end in any case 6 months after the original warranty period has expired.


The foregoing warranty obligations are conditional upon the Buyer giving within a reasonable period notice in writing of any defects that have occurred and such notice reaching the Seller. Buyer shall prove within a reasonable period the presence of a defect, in particular he shall make available within a reasonable period to Seller all material and data in his possession. Upon receipt of such notice Seller shall, in the case of a defect covered by the warranty under 8.1 above, have the option to replace the defective goods or defective parts thereof or else to repair them on Buyer’s premises or have them returned for repair, or to grant a fair and reasonable price reduction.


Any expenses incurred in connection with rectifying defects (e. g. expenses for assembly and disassembly, transport, waste disposal, travel and site to-quarters time) shall be borne by Buyer. For warranty work on Buyer’s premises Buyer shall make available free of charge any assistance, hoisting gear, scaffolding and sundry supplies and incidentals that may he required. Replaced parts shall become the property of Seller.


If an article is manufactured by Seller on the basis of design data, design drawings, models or other specifications supplied by Buyer, Seller’s warranty shall be restricted to non-compliance with Buyers specifications.


Seller’s warranty obligation shall not extend to any defects due to assembly and installation work not undertaken by Seller, inadequate equipment, or due to non-compliance with installation requirements and operating conditions, overloading of parts in excess of the design values stipulated by Seller, negligent or faulty handling or the use of inappropriate materials, nor for defects attributable to material supplied by Buyer. Nor shall Seller be li- able for damage due to acts of third parties, atmospheric discharges. Excess voltage and chemical influences. The warranty does not cover the replacement of parts subject to natural wear and tear. Seller accepts no warranty for the sale of used goods.


The warranty shall lapse immediately if, without written consent of Seller, Buyer himself or a third party not expressly authorised undertakes modifications or repairs on any items delivered.
